Delegate Fluharty moves to amend “HB3408 HFA Crouse and Ellington 2-28 #1” on page 2, Section 1, line 36, following the words “deny home instruction” by striking out the period, inserting a colon and the following proviso:

“Provided,  however, That the county superintendent may not authorize instruction in the home if there is a pending child abuse or neglect investigation pursuant to §49-2-801 et seq. of this code against either custodial parent or a person instructing the child, or if either custodial parent or a person instructing the child has ever been convicted of domestic violence pursuant to §48-27-101 et seq. of this code or child abuse or neglect pursuant to §61-8D-1 et seq. of this code.”
